“In case any of you have not been included in the emails going around, there is a problem and concern that musicians in Colorado are facing concerning the Department of Labor and how they classify band members, bandleaders, and event companies. There are no villains here, just a very important discussion that effects the livelihood of every working musician and every bandleader and every event company that hires artists to play their gigs. In simple terms, the question is: are you an independent contractor, free to work for whom ever you want, or are you an employee? The DOL’s policy, that goes back to the 1990s, is to classify any musician who makes more than 50% of their income from one band (or event company) as an employee of that company.

This is a long discussion but in short, if you are a band and you make all your money from performing with that specific band ..DOL wants to require you (and your company) to do withholding, unemployment, and matching payments…and many musicians do not see themselves that way … as employees … but as independent contractors. The difference between the two in dollars and cents, accounts fees, and money withheld is huge for the musician, the event company, the bandleader etc. So this is the issue. If you know nothing about it, I encourage you to read the ‘common law rules’ about who is and who is not an independent contractor. The current policy of the DOL is causing many bandleaders and event companies to consider ending their business because they simply cannot afford to follow DOL’s policy that is basically … if you make more than 50% of your living from one organization you are employee/employer not independent contractors. The results of not following that can be a $25,000 fine for each noncompliance.

Talent advisers, agencies, and buyers will increasingly rely on video instead of audio demos as a way to vet acts for festivals, muni-events, private events, and other gigs – and as a means of promoting the event itself.  People want to SEE what they’re getting as well as HEAR what they’re getting.  TASTE, TOUCH, and SMELL come next… but that’s really in the future.  3-D hologram tv and video is not too far off however.

Zach Heckendorf has fast become one of our rising stars in Colorado, since he graduated high school in 2011 (?) and had his debut produced by Brett Dennen.  He’s on his way to “all the right places,” according to Ricardo Baca at the Denver Post.  “All The Right Places” was shot at various locations around Denver and Colorado, including Red Rocks Amphitheatre, Mile High Stadium, Caribou Ranch Recording Studio, and Union Station.  Zach is the first artist to record at Caribou Ranch since it burned down in 1985.  Zach opens for Michael Franti & Spearhead at Red Rocks on June 8.  

I started off the show this week, as I have every week the past couple of months, with a nod to a Colorado legend, who many people don’t know lived here from the 70s until his passing in 2007 … Dan Fogelberg originally came to Colorado along with some pals like Glen Frye and Don Henley – who were working out the Eagles in Aspen in the early 70s.  Dan didn’t care for Aspen – too busy and too much partying apparently.  He wound up buying Chris Hillman’s (The Byrds, The Flying Burrito Bros., Manassas, The Desert Rose Band) place in Nederland.  In 1980, he bought land in Pagosa Springs.  He built a ranch and recording studio and moved there permanently in 1982.

The Nitty Gritty Dirt Band moved here from California in 1970 as well, after not quite making it since forming in 1965.  After any number of changes in personnel, the band’s move to Colorado was the exact catalyst the band needed to produce the still amazing “Will the Circle Be Unbroken.”  Jimmy Ibbotson is the sole remaining member of the band living in Colorado to this day.  You’ll find his name on recordings with other acts from Colorado as well, including one of the sweetest country-folk records of the past decade – “Howling At the Moon” by Runaway Express.

There was one new cut I just could not get into the show this week, so I’m including the video here … expect this cut and others from the new Joe Sampson album to get some love on the show this year.  It’s really good to see Nathaniel Rateliff on this cut

Every month, I comb through literally hundreds of daily playlists from stations all around the state in order to cull and tabulate the monthly spins charts. And here’s what I’ve found out over the past few years — the VAST MAJORITY of djs doing shows statewide on community radio stations don’t ever touch upon music by a Colorado act, known or unknown. TRUTH.

That’s taking nothing away from those who do. I want to make that perfectly clear. I’m deeply thankful to those djs, programmers, and radio stations that do make a concerted effort to get Colorado music on the air. Stations like KRFC (Fort Collins) and OPEN AIR 1340 AM (Denver) have made that commitment very obvious. On average you’ll hear somewhere in the ballpark of 13-15% of their airtime devoted to recordings from here in the state. That’s on top of the hours they devote to live in-studio appearances by Colorado acts. The rest? …less than 5% on average per month.  In many cases I’ve been hard pressed to find even five individual album titles played, let alone five with more than a spin or two a month.  There are some stations that statistically don’t air any current Colorado releases at all – in any genre.

Here’s an interesting comparison: Under the Canadian Commercial Radio Policy, 35% of all music aired each week on all AM and FM stations must be Canadian. We have no such rules in the US, even for COMMUNITY/PUBLIC radio.

35%! I can’t even begin to imagine what community radio in Colorado would sound like if we did that.  Imagine if 1 out of every 3 songs you heard was from a Colorado act … and that’s only 33%. Hell, all I’m asking for is 16.6% (2 songs per hour on average).  What kind of impact would radio have then?

Scott Foley hosts a show and serves as the de facto Colorado music genre captain, as well as the Americana music genre captain at KRFC.  When a few of us were discussing this subject on my Facebook page he wrote, “There needs to be a relationship between artists and their community stations. [As Chris has pointed out before,] we can’t support an artist if they don’t make their music available to us. Likewise, the relationship should include in-studio time, station sponsored concerts and events and even artist support during membership drives. These are mutually beneficial opportunities that allow a station to sink stronger roots into its community.”

Kerri Pastine of the Informants added; “My assumption would be that the DJs aren’t getting out and discovering all of the local music there is, but then again, I really don’t know how they get turned on to it all, as there’s so much.”

This is a complex issue for sure. The people who volunteer their time to do shows at these stations are our neighbors and our friends, our parents and our children here in the state.  I believe we all want the same result – a greater awareness of the communities we live in – that is what lies at the heart of community radio.

The solution may be as simple as getting the music straight to those who do the shows. Maybe … since what they tend to play is music they are already familiar with  …so if we can get the music directly into their hands they’ll play it …. MAYBE. We’ll see … I’m hopeful

In radio news, KBUT (Crested Butte) has a nation wide search going for a new General Manager. As of April 17th, KBUT General Manager Ryan Stringfellow has decided to step down from his position. He plans to return to Grand Junction with his family to pursue an advanced degree in Education from Colorado Mesa University. It’s spring membership drive time at nearly all of the public/community stations statewide. I know that KRFC (Fort Collins) is engaged in theirs as I write and others are also, or are about to become. Please support your local community/public radio station. Without our support, these stations truly cannot survive. For some of them (KOTO in Telluride for example) all or nearly all of the money they receive to support their efforts comes directly from supportive listeners. AND – please do request that they play more Colorado music when you make that contribution.
